# Terms of Service
##### While staying compliant, our goal has been to make these terms accessible for everyone.
### 1. Scope and Purpose
1. These general terms and conditions (« **Terms of Service** ») shall apply to all contracts entered into between us, FlowSpace (« **FlowSpace** », « **we** », « **our** » or « **us** ») and you as our user (« **User** » or « **you** »). You are only allowed to use FlowSpace’s services if you accept these Terms of Service.
2. The version of the Terms of Service that apply to your contract shall be the ones in force at the time of the conclusion of the contract.
3. We do not accept differing terms and conditions of the User, even when the User draws our attention to said differing terms and conditions and we do not expressly reject the inclusion of these terms and conditions.
### 2. Our Services and Your Use of Our Services
1. FlowSpace’s business is the provision of a productivity and task management mobile application (the « **FlowSpace App** » or the « **Services** »). FlowSpace does not guarantee that the Services meet your specific requirements or expectations.
2. Users require a personal user account (« **Account** ») to be able to use the Services. For this purpose, they must sign in with Apple Sign In. Users are responsible for ensuring that their data is up-to-date and correct and for all content created in their Account as well as for any activities occurring under their Account.
3. Users must prevent unauthorized access to their Account on the Services. FlowSpace is not liable for any loss or damages from your failure to comply with this section.
4. Users agree to inform FlowSpace without delay if they find out that unauthorized use has been made of their Account.
5. The Premium Services (defined below) can only be accessed and used by Users of at least thirteen (13) years old. If you are not at least thirteen (13) years old, you are prohibited from accessing and using the Premium Services without parental consent.
6. Users must not:
– (i) use or attempt to use someone else’s Account and/or access someone else’s personal data
– (ii) set up an Account using a false identity or the identity of another person
– (iii) access the Services in any other manner than through the methods provided by FlowSpace
– (iv) use the Services in any way that violates any applicable laws or regulations
– (v) transmit, or procure the sending of, any advertising or promotional material, including any « junk mail », « chain letter, » « spam, » or any other similar solicitation
– (vi) use the Services in a way that infringes upon the rights of others or restricts or inhibits anyone’s use or enjoyment of Services
– (vii) attempt to interfere with the proper working of Services
– (viii) reverse engineer, decompile, or disassemble the FlowSpace App
### 3. Pricing
1. The use of certain advanced features of the Services may be subject to a payment (« **Premium Services** »). The Premium Services and the respective prices for the Premium Services (« **Price** ») are shown in the FlowSpace App through Apple’s App Store pricing system.
2. The Price includes the applicable taxes as determined by Apple’s App Store. Any other duties or taxes, if any, will be handled according to Apple’s policies and your local jurisdiction.
3. All payments are processed through Apple’s App Store payment system. FlowSpace does not directly handle payment information.
### 4. Payment and App Store Integration
1. All purchases of Premium Services are handled through Apple’s App Store using your Apple ID payment method.
2. If payment for Premium Services cannot be processed through the App Store, access to Premium features may be suspended until payment is resolved through Apple’s system.
3. For payment issues, refunds, or billing questions, please contact Apple Support directly or use the « Report a Problem » feature in your Apple ID account.
4. FlowSpace uses RevenueCat to manage subscription status and provide Premium features, but all actual payments are processed by Apple.
### 5. Promotions
1. Any contests, sweepstakes or other promotions (collectively the « **Promotions** ») made available through the Services may be governed by rules that are separate from these Terms of Service. If you participate in any Promotions, please review the applicable rules as well as our Privacy Policy. If the rules for a Promotion conflict with these Terms of Service, the Promotion rules will apply.
### 6. Subscription Management and Cancellation
1. Premium Services with recurring payments will automatically renew through Apple’s App Store subscription system according to the terms you selected at purchase.
2. You can manage, modify, or cancel your Premium Services subscription directly through your Apple ID account settings:
– iOS: Settings > Apple ID > Subscriptions
– Or through the App Store app > Account > Subscriptions
3. Cancellation can also be managed within the FlowSpace App where available, which will redirect you to Apple’s subscription management.
4. If you cancel Premium Services before the end of your current paid period, you will retain access to Premium features throughout the remainder of the term you purchased.
5. For subscription issues, please contact Apple Support first, as they manage all subscription billing and processing.
### 7. Account Termination and Data Handling
1. You can delete your FlowSpace account at any time through the app settings or by contacting us at contact@unusual.software.
2. Upon account deletion:
– Your FlowSpace account data will be permanently deleted within 30 days
– Data stored in your personal iCloud account (for Premium users) remains under your control
– You should manually delete iCloud data if desired, as we cannot access your personal iCloud storage
3. FlowSpace can terminate your account by giving two (2) weeks’ notice via email to your Apple ID email address. If you have active Premium Services, termination will occur at the end of your current paid period.
4. FlowSpace reserves the right to immediately suspend or terminate accounts that violate these Terms of Service.
5. The right of termination for cause shall remain unaffected by applicable law.
### 8. Intellectual Property Rights
1. The FlowSpace App and all its content are protected by copyright and other intellectual property laws.
2. FlowSpace grants you a non-exclusive, non-transferable, revocable license to use the Services in accordance with these Terms of Service.
3. You may not:
– Copy, modify, distribute, sell, or lease any part of our Services
– Reverse engineer or attempt to extract the source code of our Services
– Use our trademarks, logos, or branding without explicit written permission
4. You retain ownership of all content you create within FlowSpace (tasks, notes, events, etc.).
### 9. Data and Privacy
1. Your use of FlowSpace is also governed by our Privacy Policy, which explains how we collect, use, and protect your information.
2. For Premium users, your content may be synchronized with your personal Apple iCloud account. This synchronization is controlled by your iCloud settings and Apple’s privacy policies.
3. FlowSpace processes personal data in accordance with applicable privacy laws, including GDPR where applicable.
### 10. Limitation of Liability
1. FlowSpace shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including but not limited to:
– Loss of profits, data, or other intangible losses
– Damages resulting from your use or inability to use the Services
– Unauthorized access to your data
– Third-party conduct or content
– Any interruption or cessation of Services
2. FlowSpace’s total liability to you for all claims related to the Services shall not exceed the amount you paid for Premium Services in the twelve (12) months preceding the claim.
3. Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so some of the above limitations may not apply to you.
### 11. Third-Party Services
1. FlowSpace integrates with third-party services including:
– Apple Sign In for authentication
– Apple iCloud for Premium data synchronization
– RevenueCat for subscription management
– Apple App Store for payments
2. Your use of these third-party services is subject to their respective terms of service and privacy policies.
3. FlowSpace is not responsible for the availability, functionality, or policies of third-party services.
### 12. App Store Terms
1. These Terms of Service are in addition to, and do not replace, Apple’s App Store Terms of Service.
2. In case of conflict between these terms and Apple’s terms, Apple’s terms shall prevail regarding App Store-related matters.
3. Apple is not a party to these Terms of Service and has no responsibility for FlowSpace or its content.
### 13. Feedback and Support
1. You may provide feedback, suggestions, or report issues to us at contact@unusual.software.
2. By providing feedback, you grant FlowSpace a non-exclusive, perpetual, royalty-free license to use, modify, and incorporate your feedback into our Services.
3. FlowSpace is not obligated to implement any feedback or suggestions you provide.
### 14. Changes to Terms
1. FlowSpace reserves the right to modify these Terms of Service at any time.
2. We will notify you of material changes at least thirty (30) days before they take effect through:
– In-app notifications
– Email to your Apple ID email address
– Updates posted in the app
3. Your continued use of FlowSpace after changes take effect constitutes acceptance of the new terms.
4. If you don’t agree to the changes, you may terminate your account before the changes take effect.
### 15. General Provisions
1. These Terms of Service constitute the entire agreement between you and FlowSpace regarding the Services.
2. If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
3. These Terms of Service are governed by the laws of France.
4. Any disputes arising from these Terms will be resolved through the courts of France.
5. FlowSpace’s failure to enforce any provision of these Terms does not constitute a waiver of that provision.
